1. Introduction This End User License Agreement (“Agreement”) is a legal contract between you (“User,” “you”) and CNS Industries LLC (“Company,” “we,” “us,” or “our”) governing your use of The Chiller Guys Hub mobile applications and software, whether accessed via iOS, Android, or other operating systems (the “App”).
By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not download or use the App.
2. License Grant We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal or professional use, subject to the terms of this Agreement.
You may not:
- Copy, modify, or distribute the App;
- Reverse engineer, decompile, or disassemble the App;
- Use the App to violate any law or regulation;
- Use the App for unauthorized commercial purposes or resale.
3. Intellectual Property All intellectual property rights in the App, including content, graphics, software, and trademarks (“IP”), are owned by CNS Industries LLC or its licensors. You do not acquire any ownership rights by using the App. Unauthorized use of our IP is strictly prohibited.
4. User-Generated Content You are solely responsible for any content (text, files, media, etc.) you upload or transmit via the App. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content as needed to operate the App.
You may not:
- Upload copyrighted content without permission;
- Share confidential or proprietary materials;
- Post harmful, harassing, or illegal content.
We reserve the right to remove content that violates these terms.
5. Updates & Modifications We may update the App periodically for maintenance, security, functionality, or legal compliance. Continued use of the App after an update constitutes acceptance of the revised version.
6. Termination We reserve the right to suspend or terminate your access to the App if you violate this Agreement or engage in any activity that may harm the Platform, other users, or our legal obligations.
Upon termination, you must cease all use of the App and delete any copies.
7. Disclaimers & Limitation of Liability The App is provided “AS IS” without warranties of any kind. We disclaim all warranties, including fitness for a particular purpose and non-infringement. We are not liable for any damages arising from your use of the App, including loss of data or business interruption.
Some jurisdictions do not allow the exclusion of certain warranties, so these limitations may not apply to you.
8. Export Control You agree to comply with all U.S. and international export laws and regulations. You may not use or export the App in violation of any applicable law.
9. Governing Law & Jurisdiction This Agreement shall be governed by the laws of the State of Wisconsin, USA. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Wisconsin, unless otherwise required by international law.
